離奇“開(kāi)瓶費(fèi)!”

自帶酒水去酒樓,然后對(duì)老板收取“開(kāi)瓶費(fèi)”的要求說(shuō)“NO”?不行!至少法律上行不通。
備受關(guān)注的北京首例“開(kāi)瓶費(fèi)”終審判決如下:酒店退還消費(fèi)者“100元開(kāi)瓶費(fèi)”,但判決的理由是酒樓沒(méi)有收費(fèi)“明示”。這將意味著,有收費(fèi)“明示”的酒店可以向消費(fèi)者合法索要“開(kāi)瓶費(fèi)”。新聞背景

The Beijing No.1 Intermediate People's Court is at odds with the grounds of the decision the Haidian District Court adopted in the first instance on Dec 21, 2006 that a restaurant must return the corkage fee to one of its customers, reported the Beijing Times on Wednesday.
報(bào)道中的“corkage fee”指的就是“開(kāi)瓶費(fèi)”,指“酒店向自帶酒水的消費(fèi)者收取開(kāi)瓶服務(wù)費(fèi)”。有時(shí),僅用“corkage”一詞也可表示“開(kāi)瓶費(fèi)”。
“Corkage”源于名詞“cork”(瓶塞),相應(yīng)的,其動(dòng)詞形式“cork”則表示“用瓶塞塞住”,如:to cork the wine securely(將酒封得嚴(yán)嚴(yán)實(shí)實(shí))。源于此,口語(yǔ)中,“閉嘴”可表達(dá)為“Put a cork in it! ”
