French luxury house Chanel on Wednesday lost its trademark fight with Huawei Technologies after a top European court said their logos bear no similarity to each other.
4月21日，法國奢侈品牌香奈兒在與華為科技的商標(biāo)糾紛中敗訴，歐洲法院裁定，兩個(gè)標(biāo)識(shí)并不相似。

The dispute dated to 2017 when Huawei sought approval from the EU Intellectual Property Office (EUIPO), a trademark body, to register its computer hardware trademark which has two vertical interlocking semi-circles.
這起糾紛始于2017年，當(dāng)時(shí)華為曾向歐盟知識(shí)產(chǎn)權(quán)局申請(qǐng)，為其計(jì)算機(jī)硬件注冊(cè)商標(biāo)，圖案為兩個(gè)在垂直方向互聯(lián)的半橢圓。

Chanel said that the design was similar to its registered French logo of two horizontal interlocking semi-circles used for its perfumes, cosmetics, costume jewellery, leather goods and clothing.
香奈兒認(rèn)為，華為的商標(biāo)設(shè)計(jì)與自家兩個(gè)水平互聯(lián)的半圓標(biāo)識(shí)相似，其商標(biāo)用于香奈兒的香水、化妝品、飾品、皮革以及服裝等產(chǎn)品。

In 2019, the trademark office dismissed Chanel's objection, saying there was no similarity and no likelihood of confusion in the mind of the public.
2019年，歐盟知識(shí)產(chǎn)權(quán)局駁回了香奈兒的反對(duì)，認(rèn)為這兩個(gè)商標(biāo)并不相似，也不會(huì)造成公眾混淆。

The French luxury house subsequently challenged the ruling at the Luxembourg-based General Court, which dismissed the appeal in its ruling on Wednesday.
隨后香奈兒又向位于盧森堡的歐盟法院提出訴訟，不過這一訴訟請(qǐng)求也在4月21日被駁回了。

The tribunal said the visual differences in the two logos were significant. "In particular, Chanel's marks have more rounded curves, thicker lines and a horizontal orientation, whereas the orientation of the Huawei mark is vertical. Consequently, the General Court concludes that the marks are different," it said.
法院認(rèn)為，兩個(gè)商標(biāo)在視覺上的差異很顯著?！坝绕涫窍隳蝺旱纳虡?biāo)是更圓滑的曲線，線條更粗且為水平方向，而華為的標(biāo)識(shí)則是豎直的。因此，法庭認(rèn)定這兩個(gè)標(biāo)識(shí)并不相同?！?br>

據(jù)BBC報(bào)道，香奈兒仍可上訴，目前并未就此事發(fā)表評(píng)論。
