近日，最高人民法院、最高人民檢察院和公安部聯(lián)合印發(fā)了《關于依法懲治妨害公共交通工具安全駕駛違法犯罪行為的指導意見》，進一步提升對公共交通安全秩序的法律保障力度。

According to the guide, passengers who grab devices such as steering wheel or gear shift lever, and conduct actions that hamper safe driving such as beating or dragging drivers should be punished for crime of endangering public security with dangerous method. The passengers should not be granted probation even if the actions did not result in grave consequences. If passengers attack drivers with instruments, they should be given severe punishment.
意見明確，對于乘客實施“搶奪方向盤、變速桿等操縱裝置，毆打、拉拽駕駛人員”等具有高度危險性的妨害安全駕駛行為的，按以危險方法危害公共安全罪定罪處罰，并強調即使尚未造成嚴重后果，一般也不得適用緩刑；具有“持械襲擊駕駛人員”等幾類特定情形的，予以從重處罰。

乘客針對其他人員實施尋釁滋事行為（causing disturbances），妨害交通運營秩序、影響行車安全的，根據(jù)具體情況分別適用尋釁滋事罪或者以危險方法危害公共安全罪定罪處罰（crime of endangering public security with dangerous method）。

《意見》強調，以暴力、威脅方法阻礙國家機關工作人員依法處置妨害安全駕駛違法犯罪行為、維護公共交通秩序的，以妨害公務罪定罪處罰（crime of endangering public affairs）；暴力襲擊正在依法執(zhí)行職務的人民警察的，從重處罰。

For drivers who are unable to resolve disputes with passengers in a sensible way and leave their post to clash with passengers, they should be punished for crime of endangering public security with dangerous method.
鑒于實踐中少數(shù)駕駛人員與乘客發(fā)生紛爭后不能理性應對，而是違規(guī)操作或者擅離職守與乘客發(fā)生沖突，《意見》規(guī)定對實施此類行為的駕駛人員按以危險方法危害公共安全罪定罪處罰。

此外，為鼓勵公共交通工具的乘務人員和乘客與妨害安全駕駛違法犯罪行為作斗爭（stand up against criminal offenses），及時制止侵害駕駛人和乘客的行為，采取緊急措施避免嚴重危害后果發(fā)生（stop actions that could cause serious consequences），《意見》還就正當防衛(wèi)（justifiable defense）、緊急避險（emergency measures）作出了原則規(guī)定。
