北京發(fā)布共享單車(chē)指導(dǎo)意見(jiàn)

北京市交通委4月21日出臺(tái)《北京市鼓勵(lì)規(guī)范發(fā)展共享自行車(chē)的指導(dǎo)意見(jiàn)(試行)(征求意見(jiàn)稿)》,對(duì)共享自行車(chē)企業(yè)進(jìn)入和退出運(yùn)營(yíng)分別進(jìn)行了規(guī)定,并明確在北京投放車(chē)輛的企業(yè)必須在本市開(kāi)立企業(yè)資金專(zhuān)用賬戶(hù),公示押金退還時(shí)限,及時(shí)退還承租人押金。

Beijing authorities on Friday issued a drafted citywide rule to regulate the unfettered bike-sharing industry, making the city the fifth Chinese metropolis to lay out concrete requirements in the area, following Shenzhen, Chengdu, Shanghai and Nanjing.
北京市于21日發(fā)布了針對(duì)目前缺乏管理的共享自行車(chē)行業(yè)的規(guī)范指導(dǎo)意見(jiàn),成為繼深圳、成都、上海、南京之后,第五個(gè)對(duì)共享單車(chē)行業(yè)出臺(tái)具體管理要求的大城市。
在北京交通委看來(lái),共享自行車(chē)出現(xiàn)以來(lái),發(fā)展總體是好的,但也出現(xiàn)了一些問(wèn)題,主要是企業(yè)亂投放(unregulated operation)、承租人亂停放(irregular parking)、押金未監(jiān)管(unsupervised deposit)、集中停放區(qū)車(chē)位不足(insufficient parking space)、車(chē)輛被侵占、破壞(bike damage)等。其中,亂停亂放問(wèn)題尤為明顯,需要政府、企業(yè)、社會(huì)及承租人統(tǒng)一認(rèn)識(shí),形成合力,共同促進(jìn)共享自行車(chē)規(guī)范發(fā)展和管理,共同維護(hù)良好的城市環(huán)境和交通秩序。
以下為本次《指導(dǎo)意見(jiàn)》中的核心要點(diǎn):
押金管理 deposit management
目前,注冊(cè)用戶(hù)大都交納了99元-299元的押金,由于注冊(cè)用戶(hù)眾多,押金總額龐大。為保障注冊(cè)用戶(hù)的合法權(quán)益,《指導(dǎo)意見(jiàn)》明確在北京投放車(chē)輛的企業(yè)必須在本市開(kāi)立企業(yè)資金專(zhuān)用賬戶(hù)(special accounts),公示押金退還時(shí)限(keep the public informed of their time limit for refund),及時(shí)退還承租人押金(return deposits to users in time)。
企業(yè)退出運(yùn)營(yíng)前要向社會(huì)公示(public notification),退還承租人押金(return all the deposits)。
用戶(hù)安全 client security
為保障承租人騎行安全,《指導(dǎo)意見(jiàn)》要求企業(yè)投放車(chē)輛應(yīng)符合國(guó)家、行業(yè)標(biāo)準(zhǔn),保證車(chē)輛技術(shù)狀態(tài)良好(meet technical requirements),滿(mǎn)足安全騎行要求,在運(yùn)營(yíng)過(guò)程中要定期檢測(cè)車(chē)輛(bikes in service need to be tested regularly),不符合質(zhì)量標(biāo)準(zhǔn)的車(chē)輛要及時(shí)退出。車(chē)輛要安裝衛(wèi)星定位裝置(bikes should be equipped with GPS systems)。
The draft document is also recommending and encouraging companies to purchase personal accident insurance and third party liability insurance for their clients.
《指導(dǎo)意見(jiàn)》同時(shí)還推薦和鼓勵(lì)企業(yè)為用戶(hù)購(gòu)買(mǎi)個(gè)人意外險(xiǎn)和第三方責(zé)任險(xiǎn)。
When accidents occur, the division of responsibility should be in compliance with the assertion identified by transport authorities. Users who break relevant regulations will face both credit loss and administrative penalties.
發(fā)生意外時(shí),要按照公安交管部門(mén)事故認(rèn)定承擔(dān)相應(yīng)責(zé)任。違反相關(guān)法規(guī)的用戶(hù)將面臨積分扣除和行政處罰。

停車(chē)管理 parking management
企業(yè)運(yùn)用系統(tǒng)功能,加強(qiáng)車(chē)輛停放秩序管理,在手機(jī)APP中標(biāo)注可停放區(qū)(parking area)和禁停區(qū)(no-parking area),引導(dǎo)承租人將自行車(chē)還至可停放區(qū)。完善承租人信用評(píng)價(jià)制度,將多次違規(guī)違約的承租人列入企業(yè)黑名單。
